Petitioner, who is in custody, seeks bail in connection with Pipra P.S. Case No. 60 of 2018 registered for the offence punishable under Sections 341, 342, 504, 302/34 of the Indian Penal Code.
Informant has alleged in the FIR that on 21.06.2018 at 3:00 PM, her husband was going to Punpun by cycle, meanwhile, co-villager Jitendra Ravidas stopped his cycle and started abusing and assaulting him. It has further alleged that after half an hour all FIR named accused including petitioner came to her house and started assaulting in the stomach of her husband and co-accused Malti Devi and Kiran Devi (petitioner) had caught hold her husband, as a result of which her husband fell down and was taken to the hospital where her husband died during treatment.
Patna High Court Cr.Misc. No.78134 of 2018(2) dt.09-01-2019 2/2 It has been submitted on behalf of the petitioner that petitioner is a lady and having 2 1⁄2 years twin daughters. There is no direct allegation against petitioner and she has no criminal antecedent and is in custody since 29.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-I cum Additional Session Judge-V, Patna arising out of Session Trial No. 655 of 2018, in connection with Pipra P.S. Case No. 60 of 2018 subject to the conditions that:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
