====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Rafiganj P. S. Case No.14 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 and Section 427 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 14.02.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 255 litres of Mahua liquor from Santro vehicle which does not belong to the petitioner. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Learned A.P.P. opposes the bail application.

No.34330 of 2021(2) dt.01-12-2021 2/2 Considering the fact that the petitioner is in custody since 14.02.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Aurangabad in connection with Rafiganj P. S. Case No.14 of 2021. The application stands allowed.
