====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chanan P.S. Case No.22 of 2012 registered under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that regarding the murder of Akli Devi, the present case was lodged against her husband Rash Bihari Mahto, brothers-inlaw of Rash Bihari Mahto and 2-3 unknown. In course of investigation, it has come in the supervision note, as detailed in paragraph-46 of the case diary, that this petitioner may have hand in the murder of the deceased being the friend of her husband Rash Bihari Mahto. Except that, there is nothing in the

Patna High Court CR. MISC. No.76813 of 2018(5) dt.30-04-2019 2/2 entire case diary to show the involvement of the petitioner in the commission of the alleged offence. Further submission is that the petitioner has no criminal antecedent.

On the other hand, learned A.P.P. for the State submits that name of the petitioner surfaced in the supervision note to the effect that the petitioner is the friend of Rash Bihari Mahto, the husband of the deceased.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Lakhisarai, in connection with Chanan P.S. Case No.22 of 2012, subject to the conditions laid down under Section 438(2) Cr.P.C.
