JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seek regular bail in connection with Nabinagar P.S. Case No. 40 of 2022, registered for the offence punishable under Sections 448, 341, 323, 379, 384, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. Similarly situated coaccused namely Golden Kumar Das @ Golden Kumar @ GOLDEN Das has been granted bail by a coordinate Bench of this Court vide order dated 25.04.2023 passed in Cr. Misc. No. 13010 of 2023. Petitioner is in custody since 14.01.2023. Learned APP has vehemently opposed the prayer for

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Nabinagar P.S. Case No. 40 of 2022.
