Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Matihani P.S. Case No. 151 of 2021 registered for the offence under Sections 307, 302/34 of the Indian Penal Code and 27 of

Patna High Court CR. MISC. No.25217 of 2023(2) dt.23-05-2023 2/3 the Arms Act.

The prosecution case in short is that while the informant with his sons Kunal Kumar @ Dillu (deceased) and Ankit Kumar were returning after distributing the invitation card, all of sudden Gulshan Kumar, Vivek Kumar@ Batohi, Ajit Kumar, Mukesh Kumar @ Bhulla and two unknown persons holding different weapons surrounded them. It is alleged that Ajit singh, Gulshan Singh, Mukesh Kumar @ Bhulla fired upon them, as a result of which the son of the informant namely Kunal Kumar @ Dillu (deceased) sustained fire armed injury and ultimately he succumbed to his injury. Learned counsel for the petitioner submits that the petitioner is in custody since 06.09.2022 and the petitioner is quite innocent and has committed no offence.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the fact that the petitioner has 10 antecedents and the petitioner is said to have killed the deceased and similarly situated co-accused persons have moved before this Court for grant of bail but there application for bail was rejected by this Court.

Considering the aforesaid facts, I am not inclined to

This application stands rejected.
