The only grievance of the petitioner is that though he has retired from service on 30.9.2000 but the benefit of revision of pension in view of 6th pay revision has not been given to him as yet along with the arrears. He claims to have filed a representation dated 10.6.2014 before the respondent no. 3, a copy of which has been appended as Annexure 1 but no step has been taken by him. In above view of the matter, this writ application is being disposed of with a direction to the petitioner to file a fresh representation before the respondent no. 3 giving all the details along with a copy of this order.
Patna High Court CWJC No.10270 of 2015 dt.20-07-2015 2/2 If such representation is filed, let the same be considered by respondent no. 3 within a period of six weeks from the date of filing of the same and if the petitioner is found entitled for the grant of benefit of revision of pension in view of 6th pay revision, the same should be granted to him within a further period of two weeks from the date of such decision, failing which unpaid admitted amount would carry simple interest @ 10 % per annum to be calculated from the date it became due till the date of its final payment.
However, it is further made clear that, in case the claim of the petitioner does not find favour with the respondent no. 3 then he should record reasons and pass a speaking order. (Dr. Ravi Ranjan, J) Spd/- U
