JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-08-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Jandaha P.S. Case No. 185 of 2019 for the offence under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the instant case petitioner was not named in the FIR. His name surfaced on the confessional statement of co-accused Anil Rai. Learned counsel would submit that nothing was recovered from possession of the petitioner neither the alleged looted articles nor the petitioner was put on T.I. parade for identification. The petitioner is in custody since 20.01.2020.

Considering the fact that the petitioner has remained

Patna High Court CR. MISC. No.21204 of 2020(3) dt.20-08-2020 2/2 in custody for seven months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 185 of 2019, subject to the condition that the bailors shall be local residents of the petitioner.
