Petitioner seeks bail in Bahadurpur P.S. Case No.120 of 2018 instituted for the offence under Section(s) 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. It is alleged that informant got information that this petitioner along with Manoj Manjhi is engaged in illegal sale and purchase of prohibited liquor. It is further alleged that 47.53 litres foreign liquor and 100 litres country made liquor has been recovered from top floor of a government building situated in front of Bahadurpur slum.

Seizure list is part of the First Information Report,

Patna High Court Cr.Misc. No.77491 of 2018(2) dt.15-01-2019 2/2 which shows that there is no recovery of any illicit liquor from conscious possession of this petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Bahadurpur P.S. Case No.120 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
