The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 406, 307, 354/34 of the Indian Penal Code.
The basic accusation is of torture and performing second marriage.
The matter was adjourned several times for filing affidavit by the petitioner with respect to second marriage as alleged by the counsel for the informant. But the said affidavit has not been filed as the counsel for the petitioner submits that he has no instruction.
However, counsel for the informant on instruction
Patna High Court Cr.Misc. No.48786 of 2015 (3) dt.10-12-2015 2/2 submits that the informant is ready to resume the conjugal life with the petitioner.
Considering the nature of accusation, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lakhisarai Mahila P.S. Case No. 4/2015, pending before the learned CJM, Lakhisarai. With the above observation, this application is, accordingly, disposed off.
