JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 374 of 2018, disclosing offences under Sections 406, 420 of the Indian Penal Code and Section 138 of the N.I. Act.

Case is under Sections 420 & 406 of IPC. On appearance of opposite party no.2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 24.01.2019. Now the Mediator's report is available on record, which disclosed that the dispute has been resolved between the parties in terms of settlement mutually agreed upon by them and the statements with regard to the same are also

In such view of the matter, the provisional bail granted to the petitioner vide order dated 24.01.2019 is confirmed with the condition that he will abide by the conditions as mentioned in the terms of the agreement and in the memorandum of the agreement, which took place between the parties, if the petitioner fails to abide by any of the conditions mentioned in the above said agreement, the opposite party no.2 is at liberty to move for cancellation of bail bonds of the petitioner before the learned court below.

Let a copy of Mediator's report along with memorandum of the agreement is sent to the learned court below for needful.
