====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Excise Case No.182 of 2021 arising out of Makhdumpur P. S. Case No.83 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2021, he is a person with clean antecedents and charge-sheet has been submitted in this case.

Allegation is of recovery of 90 litres of Indian made foreign liquor from Swift Dzaire white colour car. Learned counsel for the petitioner submits that the said car does not belong to the petitioner rather petitioner is the

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 28.02.2021, he is a person with clean antecedents and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Jehanabad in connection with Excise Case No.182 of 2021 arising out of Makhdumpur P. S. Case No.83 of 2021. The application stands allowed.
