JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2019 The present writ petition has been filed seeking the following reliefs :- (i) For directing the respondents to hand over charge of the Residential Model Midddle School Bhaisasur, Bihar Sharif to the petitioner who has been properly posted as Headmaster in the light of the office order vide memo no. 770 dated 24.10.2018 issued by the Block Education Officer, Bihar Sharif, Nalanda and she has given joining on 26.10.2018 and since then she is regularly performing duty but knowingly and wilfully after retirement of Madhuri Kumari who was senior to the petitioner dated 31.01.20169 charge has been given to another teacher Reny Kumari who is assistant teacher.

(ii) For directing the respondents to pay salary to petitioner from October 2018 to February 2019 and June 2018 which has not been given to the petitioner without any reason.

The learned counsel for the petitioner submits that the petitioner has already submitted a representation to the respondent no. 5 i.e. the District Education Officer, Nalanda at Bihar Sharif regarding her aforesaid grievances but now she would be filing a fresh representation before the respondent no. 5 within a period of four weeks from today, hence the respondent no. 5 be directed to consider the case of the petitioner expeditiously and take a final decision.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of with a direction to the petitioner to file a representation before the respondent no. 5 within a period of four weeks from today and the respondent no. 5 shall dispose of the same within a period of eight weeks thereafter considering the order passed by the Principal Secretary, Human Resources Department, Government of Bihar dated 10.10.2018, which the petitioner shall annex along with her representation.
