2. The petitioner is apprehending arrest in connection with Bihpur P.S. Case No. 40/2024 registered on 29.01.2024 for the offenses punishable under Sections25(1-B)a, 26 of the Arms Act.

3. As per the prosecution, the FIR has been lodged against the sole petitioner alleging therein that the police force in the course of investigation, in connection with Bihpur P.S. Case No. 39/2024, raided the house of the petitioner, but the petitioner on seeing the police party fled away from there. Subsequently, in the course of a search, from the house of the

Patna High Court CR. MISC. No.25163 of 2024(2) dt.01-05-2024 2/2 petitioner, a country-made pistol along with 14 live cartridges was recovered.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. In fact, the alleged recovery has been made from the backside of the house of the petitioner. The petitioner has been roped in the present case only due to dirty village politics.

5. Learned APP for the State vehemently opposes the prayer for bail and submits that the petitioner on seeing the police party fled away from the scene and recovery of arms have been made from his house. Moreover, his antecedent is not clean.

6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Bihpur P.S. Case No. 40/2024, pending before the learned ACJM, 1st Naugachia is hereby rejected.
