Counsel for the petitioner submits that petitioner is fairly paying the maintenance amount and he is not defaulter in paying the maintenance of Rs. 5,000/- as to his wife and 1,000/- to his son. Counsel for the petitioner submits that petitioner has huge liability in the family due to the reason that in the family old aged mother and father, one handicapped brother and two daughters are there. In this view of the matter, petitioner is not in a position to pay such amount.

Counsel for the State submits that this is the order passed in the year 2017. Six years has lapsed and definitely the

Patna High Court CR. REV. No.671 of 2017(2) dt.23-03-2023 2/2 amount of salary has increased. So he submits that it is directed to enhance the payment.

Considering the liability upon the petitioner as mentioned by counsel for the petitioner, I am not inclined to enhance the said amount but also not interfering in the said order dated 23.03.2017. He is directed to continue the same. With this view of the matter, this Cr. Revision application is hereby dismissed.
