The petitioner seeks bail in connection with Case No.C2/296/2016 registered under Section 30(A) of the Bihar Excise Amendment Act, 2016.

The accusation is that three persons including the petitioner were apprehended by the police and on search, 13 bottles of Royal Stag Wine, each containing 750 ml., and 50 bottles of AC Gold wine, each containing 180 ml., were recovered from their possession.

Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in

Patna High Court Cr.Misc. No.55676 of 2016 (3) dt.28-01-2017 2/2 custody since 06.10.2016. Further submission is that the similarly situated co-accused Dinesh Kumar has already been granted bail by a Bench of this Court vide order dated 08.12.2016 passed in Criminal Misc. No.53151 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Case No.C2/296/2016.
