JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 Petitioner seeks bail in anticipation of her arrest in connection with Pipra P.S. Case No. 59 of 2018 registered for the offences punishable under Sections 304B and 120B/34 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of causing death of grandson (Nati) and daughter of the informant.
Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence. On the other hand, learned APP has opposed the prayer for anticipatory bail drawing my attention towards paragraph-8 of the case diary in which witness has named this petitioner and other accused persons, who were seen fleeing from the place of occurrence just after the occurrence.
Patna High Court CR. MISC. No.21358 of 2019(4) dt.12-07-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. She may surrender and pray for regular bail, which shall be considered on its own merit.
