This application seeks restoration of CWJC No. 9215 of 2005 which was dismissed for non prosecution vide order dated 11.11.2012. The said order reads thus:- "Nobody appears on behalf of the petitioner.
Mr. Ahsan, learned counsel for the respondentUnion of India and its officials is present. Petitioner seeks quashing of the order of the disciplinary authority (Annexure-5), the appellate authority (Annexure-6) as also the review order at Annexure-8.
It is pointed out by learned Assistant Solicitor General that going through the materials on record including the averments made in the counter affidavit it does not appear that there is any procedural flaw in the decision making process meriting interference. Since nobody has appeared to press this application, it is dismissed for nonprosecution."
Patna High Court MJC No.2341 of 2014 (4) dt.06-05-2015 2 / 2 In view of the reasons stated in the application, I am not satisfied that a case for restoration of the writ application is made out. The application is dismissed.
The dismissal of this application shall, however, not preclude the petitioner from filing a separate writ application if the cause survives.
