The petitioner seeks bail in Shastri Nagar P.S. case No. 121 of 2011, corresponding to Sessions Trial No. 134 of 2012, under Section 399, 402, 414 of the Indian Penal Code and under Section 25(1-a) B, 26, 35 of Arms Act.

The informant, a police officer, arrested seven persons, who were preparing to commit dacoity, and the apprehended persons disclosed the name of six persons, including the petitioner, Pintu Kumar @ Langara that petitioner and others managed to flee away.

The learned counsel for the petitioner submits that petitioner is in jail since 17.06.2012. Nothing has been recovered from the possession of the petitioner. The petitioner has already

Patna High Court Cr.Misc. No.54905 of 2016 (3) dt.28-02-2017 2/2 remained in jail in this case for last four and half years only because the petitioner has got criminal antecedent. It is further submitted that petitioner has not moved this court earlier for grant of bail.

Considering the facts aforesaid and the fact that petitioner is in jail for last four and half years, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Patna in Sessions Trial No. 134 of 2012, arising out of Shastri Nagar P.S. Case No. 121 of 2011, subject to condition that one of the bailors shall be close relative of the petitioner. (Prabhat Kumar Jha, J) BKS/- U T
