The petitioner seeks bail in Ishakchak (Tilkamanjhi) P.S. case No. 27 of 2016 under Section 393 of the Indian Penal Code and under Sections 25(1-b) A, 35 of the Arms Act. The petitioner is not named in the FIR. The informant alleged that three persons came on a motor cycle and two persons pointed out pistol on him but, in the meantime, the police vehicle went there and the accused persons managed to flee away. It is submitted that one Gaurav Kumar Pandey confessed his guilt in another case and disclosed that he along with petitioner and others committed the present offence. It is submitted that Gaurav Kumar Pandey has already been enlarged

Patna High Court Cr.Misc. No.54932 of 2016 (3) dt.28-02-2017 2/2 on bail vide order dated 03.10.2016 passed in Cr. Misc. No. 38397 of 2016 and the case of petitioner stands on better footing. The petitioner is in jail since 08.11.2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Bhagalpur in Ishakchak (Tilkamanjhi) P.S. Case No. 27 of 2016.
