This application for anticipatory bail arises out of Hajipur Town P.S. Case No. 662 of 2018 for the offence under Sections 147, 148, 149, 295(A), 153(a) and 302 of the Indian Penal Code and Section 27 of the Arms Act.

In the occurrence, one person died and another received fire arm injury as disclosed in the First Information Report. There were 10-15 persons, who are said to have participated in commission of offence.

Learned counsel appearing on behalf of the petitioner has submitted that there is no specific allegation of assault against this petitioner. However, considering the seriousness of the allegation made in the First Information Report, I am not inclined to grant the petitioner privilege of anticipatory bail as it is evident from the First Information Report that petitioner was

Patna High Court CR. MISC. No.20593 of 2019(2) dt.03-04-2019 2/2 one among other persons named in the First Information Report, who had participated in commission of the offence. This application is accordingly rejected.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
