JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 The present application has been for modification of the order dated 24.08.2015 passed in Criminal Miscellaneous No.34297 of 2015 in connection with Complaint Case No.804C/2013 to the extent that in the sixth paragraph, of the order inadvertently, "learned CJM, Khagaria" has been recorded in stead of "learned SDJM, Khagaria". The said mistake perpetuated in the order since it was wrongly mentioned in the first paragraph as well as prayer portion of the main petition. Hence, learned counsel for the petitioner is permitted to make necessary correction in the first paragraph as well as prayer portion of the main petition.

In view of the aforesaid, let "learned SDJM, Khagaria" be read in the sixth paragraph of the order dated 24.08.2015 in stead of "learned CJM, Khagaria". Let the date of surrender be extended by three weeks calculated from the date of receipt or production of the

Patna High Court Cr.Misc. No.46854 of 2015 (2) dt.09-12-2015 2/2 order.

The order dated 24.08.2015 passed in Criminal Miscellaneous No.34297 of 2015 stands modified to the extent as indicated above.
