JUSTICE SANDEEP KUMAR ORAL ORDER 21-08-2023 This is an application for quashing the order dated 02.07.2015 passed by learned C.J.M. Gaya in Bodhgaya P.S. Case No. 151 of 2014 by which the learned Magistrate took cognizance for the offences under Section 341, 323, 34, 498A of the IPC and under Section 3⁄4 of the Dowry Prohibition Act.

2. Learned counsel for the petitioners has relied upon annexure-ii and has submitted that matter has been settled between the parties.

3. In view of the settlement between the parties, this application is disposed of with direction to the learned Magistrate to consider the compromise petition and pass an

Patna High Court CR. MISC. No.46693 of 2015(2) dt.21-08-2023 2/2 order for dropping the criminal prosecution against the accused person if the compromise is supported by the advocate for the O.P. No. 2.

4. If the O.P. No. 2/informant chooses not to appear in the trial Court, then also the necessary order shall be passed in accordance with law. The aforesaid order must be passed within one month of receipt of a copy of this order as the Court is unnecessarily keeping the matter pending since 2015.

5. With the aforesaid observation and direction, this application is disposed of.
