The petitioner seeks bail in Buxar Town P.S. Case No. 391/2016, registered for the offences punishable under Sections 341, 323, 353 and 307 of the Indian Penal Code and Section 52 of Prisoner Act.

The Jail Superintended, Buxar alleged that the petitioner and two others called Budul Yadav and when Budul Yadav did not come, the petitioner and other accused persons, namely, Varun Mishra and Sanjeev Mishra assaulted him. The accused persons also assaulted Bangur Pandey, the ward incharge. Learned counsel for the petitioner submits that there is no injury either to Budul Yadav or Bangur Pandey. The petitioner has falsely been implicated in the case. The petitioner is in jail

Patna High Court Cr.Misc. No.3025 of 2017 (3) dt.03-03-2017 2/2 since 26.09.2016.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. 391/2016.
