JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-05-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner Nos.1, 3 and 5.

Prayer is allowed.

This anticipatory bail petition is dismissed as withdrawn against petitioner Nos.1, 3 and 5. Heard learned counsel for the petitioners and the State.

Petitioners No.2 and 4 apprehend their arrest in a case

Patna High Court CR. MISC. No.23846 of 2022(2) dt.26-05-2022 2/2 registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code. Learned counsel appearing for the petitioners submits that specific accusation of assault is against other accused persons. Allegation against petitioners No.2 and 4 is general and omnibus. Injury has been found to be simple in nature. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and nature of accusation, let the petitioners No.2 and 4, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Darbhanga in connection with Sadar PS case No. 163/2018, subject to conditions laid down u/s 438(2) of the Cr. P. C.
