The petitioner apprehends his arrest in connection with Raghopur P.S. Case No.140 of 2019, registered for the offences punishable under Sections 341, 323, 307, 337, 504, 506 and 34 of the Indian Penal Code.

The petitioner alongwith two other co-accused persons, namely, Naresh Das and Rajeshwar Das is said to have assaulted the informant by means of lathi on his head and hand causing injuries to him.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted

It is submitted that the injuries sustained by the informant are simple in nature. It is lastly submitted that there is case and counter case between the parties on account of admitted land dispute.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Considering the facts that there is admitted land dispute between the parties and injuries sustained by the informant are simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Vaishali at Hajipur in connection with Raghopur P.S. Case No.140 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
