====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable u/s 409, 420 and 120 B of IPC.

3. As per prosecution case, petitioner being Ward Member of Ward No.8 allegedly embezzled the Govt. money of certain Govt. schemes in collusion of with accused persons.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. However, without prejudice to his case, petitioner is ready to deposit Rs. 1.5 lacs in instalments which is half of the alleged embezzled amount. Petitioner has got no criminal antecedent.

5. Learned APP for the State opposed the prayer for bail.

6. Having regard to the facts and circumstances of the case and considering the statement of the petitioner, let the above named petitioner, be released on provisional bail in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.22981 of 2025(2) dt.26-06-2025 2/2 within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Nagar Police Station Case No. 276 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as on the following conditions:- a) Petitioner shall deposit Rs. 50,000/- in the Nazarat of the concerned Civil Court and shall furnish a receipt to this effect at the time of furnishing bail bond. Rest amount of Rs. 1 lac shall be deposited by the petitioner within further four months in equal instalments. Deposits shall be subject to the result of the case.

b) If the petitioner complies with the conditions, provisional bail of the petitioner shall be confirmed by the court below itself.
