JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by learned counsel appearing for the informant.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34,120B of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the first information report but only suspicion has been raised against the petitioner. The informant is not an eye witness of the alleged occurrence and she got information from one Hasin, who gave information to the informant that her son was killed by some unknown persons. However, it would appear from perusal of the impugned order that the petitioner was arrested on the basis of

It appears that except the aforesaid confessional statement, there is nothing against the petitioner. Moreover, it is informed that the investigation has already been completed. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna city, Patna in connection with Fathua P.S.
