The petitioner is accused in connection with Raghunathpur P.S. Case No. 25 of 2016, registered under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, suspicion was raised against the petitioner and three others, namely, Chandrama Yadav, Sanjay Chaurasia, Akshya Lal Yadav etc. Further submission is that it has come in para 72 of the case diary Chandrama Yadav, Sanjay Chaurasia, Hari Shankar Yadav (petitioner) and Akshya Lal Yadav had come with the deceased to attend the marriage ceremony, but deceased did not return to his house and thereafter, Police got recorded the
Patna High Court Cr.Misc. No.53739 of 2016 (3) dt.25-01-2017 2/2 confessional statement of petitioner as detailed in para 84 showing his hand in the murder of the deceased, except that there is nothing against the petitioner to show his involvement in the present case. Further submission is that petitioner has no criminal antecedent is in custody since 12.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Raghunathpur P.S. Case No. 25 of 2016.
