ANJANA MISHRA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of opposite party No.2 as well as the learned counsel appearing on behalf of the State. The petitioner and the O.P. No.2 had agreed to mediation process and upon such mediation, the parties have settled the disputes. It has been agreed upon by both the parties that one time settlement shall be given to opposite party No.2 to the tune of Rs.64,000/- (Sixty-four thousand), which will be payable in two instalments. It has further been agreed upon by the petitioner that he shall return one Trunk and Almirah and other useful utensils and a golden ring given at the time of

It has further been agreed upon that the petitioner shall deposit a sum of Rs.300/- (Three hundred) per month in Bank account to be opened by the mother of the child and deposited in the court below by the petitioner by the first week of each month. Considering the aforementioned settlement arrived at between the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur (Supaul), in connection Complaint Case No.472-C/13, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
