ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.10.2018 in connection with Excise Case No.941 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that 50 litres illicit liquor is alleged to have been recovered from the motorcycle. Learned counsel for the petitioner submits that the said has not been recovered from the conscious possession of the petitioner but was recovered from the Jute bag. It is further submitted that the petitioner has got no criminal antecedent. Considering the aforementioned facts and
