JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Dhaka P.S. Case No. 127 of 2016, disclosing offences under Sections 341, 323, 506, 363, 366/34 of the Indian Penal Code.
Allegation is of abduction of the daughter-in-law of the informant and petitioner in not named in the F.I.R. Submission of learned counsel for the petitioner is that his name transpired in the statement of victim girl recorded under Section 164 Cr.P.C. and no overt act has been attributed against this petitioner and she has categorically stated that she was taken to Mumbai and only Rakesh Singh was present there. Further submission is that other co-accused person has been granted privilege of anticipatory bail vide order dated 11.10.2018 passed in Cr. Misc. No. 55653 of 2018.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, in connection with Dhaka P.S. Case No. 127 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
