The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 47(a)(f) of the Excise Act.
Learned counsel for the petitioner submits that certain raids were made on the premises of the petitioner and illicit Mahua wine is said to have been recovered from the said place. It is further submitted that the seizure-list does not bear the signature of the petitioner and the recovery was not made from his conscious possession.
Considering the aforementioned submission and also the fact that the petitioner has no criminal antecedent of similar nature, let the petitioner, in the event of his arrest / surrender
Patna High Court Cr.Misc. No.46900 of 2015 (3) dt.21-01-2016 P2/2 within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Shergahti, Gaya, in connection with Excise Case No. 13/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
