JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 392 of the Indian Penal Code. The prosecution case is that on 06.07.2015 at about 7:30 P.M while the complainant along with his maternal uncle was going to his house from Murliganj Bazar, the accused persons surrounded and attempted to rob the motorcycle. On protest being made the accused persons abused the complainant and his uncle and made assault. It is alleged that petitioner took out Rs. 14,740/- from the pocket of the uncle of the complainant while co-accused Sajan Yadav snatched gold chain and threatened the complainant.

Patna High Court Cr.Misc. No.47950 of 2015 (2) dt.04-11-2015 2/2 It is submitted by learned counsel for the petitioner that cousin brother of the petitioner Rakesh Kumar Ranjan lodged Murliganj P.S. Case No. 128 of 2015 levelling accusation under Sections 341, 323, 325, 379, 324, 504, 506/34 of the Indian Penal Code against the present complainant and others. Thereafter the present complaint was filed on 08.07.2015 for the alleged occurrence of 06.07.2015. The petitioner is teacher in the school.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the case lodged by the petitioner's side at earlier point of time and the petitioner having no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhepura in connection with Complaint Case No. 656 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
