NILU AGRAWAL ORAL ORDER 05-04-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner seeks bail in connection with Pasraha P.S.Case No.108 of 2018/G.R.No.2359 of 2018 for the offence alleged under Sections 304B and 201/34 of the Indian Penal Code.
The prosecution case as lodged by the informant is that her daughter Kajal Kumari was married to one Manish Thakur one and half years back. She was harassed for a motorcycle and cash of Rs.50,000/- by her husband and in-laws and the informant came to know that she has been killed by her in-laws and the petitioner along two others being co-villagers were instrumental in disposing of the dead body.

No.21354 of 2019(2) dt.05-04-2019 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent, was not the family member in-laws of the deceased, was just a villager and general and omnibus allegations have been levelled against him. No physical or mental torture has been levelled against the petitioner and two of the ladies member of the inlaws family have already been granted pre-arrest bail by a coordinate Bench of this Court in Cr.Misc.No.11272 of 2019 dated 25.02.2019. Petitioner is languishing in judicial custody since 28.01.2019 and undertakes to cooperate in the investigation/trial and appear before the police/court as and when required.
However, learned APP for the State opposes the prayer for bail.
Considering the nature of allegations and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Pasraha P.S.Case No.108 of 2018/G.R.No.2359 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Khagaria subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable
