JUSTICE SANJAY PRIYA ORAL ORDER 25-01-2017 This is an application for grant of bail for offences punishable under Sections 302/34 of the Indian Penal Code. Heard learned counsel for the petitioner.
It is alleged in the written report that this petitioner took son of the informant for drinking, thereafter, dead body of the son of the informant was found in a pond.
It is further alleged that dewar of the informant, namely, Nawal Kishore Singh, called him on mobile that dead body of the son of the informant was lying in the tank near Ramjanaki Mandir.
The counsel for petitioner has submitted that in the case diary there is no eye witness to the occurrence. It is further submitted that Nawal Kishore Singh in para-28 of the case
Patna High Court Cr.Misc. No.52382 of 2016 (3) dt.25-01-2017 2/2 diary has stated that he has got information from Vinod Singh and Vinod Singh in his statement at para-15 of the case diary has not taken the name of Nawal Kishore Singh. As such, it appears to be a case of last seen. Petitioner is in custody since 9.9.2016. The learned A.P.P. does not contradict such statement of the counsel for petitioner.
Considering the facts and circumstances of the case , let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani, in connection with Kaluahi P.S. Case no. 66 of 2016. (Sanjay Priya, J) sudip/- U T
