The petitioner is in custody in connection with Gopalpur P.S. Case No. 01 of 2020, for the offence under Section 272, 273 and 420 of the Indian Penal Code and Sections 30(a), 35, 38 of the Bihar Prohibition and Excise (Amendment ) Act, 2016 and amended Act, 2018.
Learned counsel for the petitioner submits that in the instant case, total 63 litres of country made liquor was seized. He further submits that nothing was seized from conscious possession of the petitioner. Petitioner is in custody since 03.01.2020.
Considering the fact that the petitioner is in custody since 01.06.2020, the Court is inclined to grant bail to the
Patna High Court CR. MISC. No.26146 of 2020(2) dt.12-10-2020 2/2 petitioner, subject to the condition that the petitioner has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-2ndcum-Special Judge, Excise, Gopalganj in connection with Gopalpur P.S. Case No. 01 of 2020.
Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
