JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 21.06.2016 passed in Cr. Misc. No. 25672 of 2016 but submission on behalf of the petitioner is that petitioner is in jail custody since 03.03.2016 whereas having more or less similar allegation, co-accused, Jito Bind and Anoj Bind have already been granted privilege of bail by different Benches of this Court vide order dated 18.10.2016 passed
Patna High Court Cr.Misc. No.2687 of 2017 (2) dt.01-03-2017 2/2 in Cr. Misc. No. 45053 of 2016 and order dated 26.10.2016 passed in Cr. Misc. No. 36737 of 2016 respectively.
Since having similar allegation co-accused have already been granted privilege of bail by different Benches of this Court, let the petitioner, with an intent to maintain the parity of justice, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S.
