After some arguments, learned counsel seeks leave to withdraw this bail application as against petitioner no.1 Niranjan Chaudhary to surrender before the court below to seek regular bail.
Accordingly, this bail application, so far as petitioner no. 1 is concerned, is dismissed as withdrawn with the aforesaid liberty granted to petitioner no.1.
Petitioner no. 2 Chhotu Choudhary apprehends his arrest in connection with Khagaria (Muffasil) P.S. Case No. 220/2015 registered for offences punishable under Sections 147,
Patna High Court Cr.Misc. No.48412 of 2015 (4) dt.13-04-2016 148, 149, 307, 504, 506 of the Indian Penal Code and 27 of Arms Act.
It is contended on behalf of petitioner no. 2 that he has not been assigned any role in commission of offence save and except that he was a member of the unlawful assembly. It is further submitted that he has got clean antecedent. Having regard to the facts and circumstances of the case, let petitioner no. 2 Chhotu Choudhary be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Khagaria (Muffasil) P.S. Case No. 220/2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
