The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant was proceeding to the bank on his motorcycle to deposit Rs. 8.10 lacs in cash, the accused persons made an attempt to snatch the bag containing cash. While some of the cash was thrown around, the accused managed to escape with around Rs. 7.5 lacs. It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. No.36047 of 2021(2) dt.21-12-2021 2/2 accused Kapil Kumar, Rahul Kumar and Awinash Kumar @ Bittu Sharma made before police and which has been recorded in paragraph nos. 51, 78 and 79 of the case diary. The said Kapil Kumar has been enlarged on bail vide order dated 28.2.2020 passed in Cr. Misc. no. 11867 of 2020. No incriminating article has been recovered from the petitioner's possession. He is in custody since 30.1.2021 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail to the aforesaid Kapil Kumar on whose confessional statement the name of the petitioner transpired, the petitioner is directed to be enlarged on bail in connection with Sherghati P.S. Case no. 570 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 5th, Gaya.
