In the present writ application, the petitioners have prayed for the grant of following reliefs:- (i) For directing the respondent no. 1 to take action upon the representation of the petitioners within a limited time frame and to initiate inquiry against the respondent nos. 6 to 12 as prescribed under the Multi-State Co-operative Societies Act, 2002 and to ensure that all payment which is due shall be paid as soon as possible to the investors/creditors.
(ii) To direct the respondent no. 2 to initiate investigation under the provisions of Companies Act, 2013 and to ensure that all payment which is due shall be paid as soon as possible to the investors/creditors.
(iii) To direct the respondent no. 3 to act upon the representations of the petitioners within a limited time frame and to initiate an investigation into the whole matter and also to attach all properties, both movable and immovable, of the private respondents within their jurisdictional authority so as to make the money of investors/creditors more secure.
(iv) To direct the respondent nos. 6 and 7 and the private respondent nos. 8 to 12 to ensure the return of money of the investors/creditors
8/9 which has already reached its maturity date along with the interest on delayed payment.
(v) To direct private respondents to return the amount payable to the creditors who have invested the money through the petitioners. (vi) For a direction to initiate a CBI enquiry against the respondent nos. 28 to 34 since they have misappropriated/embezzled more than hundred crore rupees of the investors within the State of Bihar.
(vii) To provide protection to the Manager of Facilitation Centre since they are facing repeated threat from the investors and they themselves are investors and victim of the act of the respondent nos. 28 to 34.
(viii) For any other relief/reliefs if petitioners found entitle in the facts and circumstances of the present case.

Learned counsel appearing for the Union of India submits that for seeking the reliefs as prayed for by the petitioners in the present writ application, the petitioners ought to have approached the Co-operative Ombudsman in terms of Section 85A of the Multi-State Co-operative Societies Act, 2002 and hence, on the ground of alternative remedy being available to the petitioners, the present writ application may be dismissed.
4. Learned counsel appearing for the respondent no. 5 supports the contention made by the learned counsel appearing

5. After making some argument, learned counsel for the petitioners submits that the present writ application may be disposed of granting liberty to the petitioners to raise their grievance before Co-operative Ombudsman in terms of Section 85A of the Multi-State Co-operative Societies Act, 2002.

This writ application stands disposed of granting liberty to the petitioners to approach the Co-operative Ombudsman under Section 85A of the Multi-State Co-operative Societies Act, 2002 within two weeks from today and in case, the petitioners approach the Ombudsman within the stipulated period, the same shall be heard and decided on merits by giving due opportunity to the petitioners and other parties concerned by passing a reasoned and speaking order. It is made clear that the final order shall be passed by the Ombudsman within a period of four weeks from the date the petitioners approach the Ombudsman under Section 85A of the Multi-State Co-operative Societies Act, 2002.
7. With the aforesaid liberty granted to the petitioners, the present writ application stands disposed of. (Alok Kumar Sinha, J) kiran/- U
