ANJANA PRAKASH ORAL JUDGMENT Date: 19-04-2016 The petitioners seek revision of the order dated 18.10.2006 passed by the Additional District and Sessions Judge, F.T.C V, Katihar in Cr. Revision No. 45 of 2005 by which he has set aside the order dated 21.03.2005 passed by the Chief Judicial Magistrate, Katihar in Complaint Case No. 1460 of 2004. The case of the complainant was that they had opened two accounts in Kosi Kshetriya Gramin Bank, Mirchaibari, Katihar and when went to withdraw the money only part of it was paid to them. It appears that after full consideration the Magistrate had dismissed the complaint and therefore, there was no justification to set aside the order.

In such circumstances, the application is allowed and the

Patna High Court CR. REV. No.95 of 2007 dt.19-04-2016 revisional order dated 18.10.2006 passed by the Additional District and Sessions Judge, F.T.C V, Katihar in Cr. Revision No. 45 of 2005 by which he has set aside the order dated 21.03.2005 passed by the Chief Judicial Magistrate, Katihar in Complaint Case No. 1460 of 2004 is hereby set aside.
