JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is a lady and younger sister of the husband of the deceased.

From the First Informant Report, it appears that the deceased was married to Md. Ali Hasan nearly ten years prior to the death of the deceased. There is allegation torture by the family members of the husband of the deceased on the daughter of the informant.

Patna High Court Cr.Misc. No.51426 of 2014 (2) dt.07-05-2015 Learned counsel for the petitioner submits that all members of the family of the husband of the deceased have been implicated maliciously. He has further been submitted that so far this petitioner is concerned, there is no material to connect her with the offence under Section 302 of the Indian Penal Code. In view of the submission as above, let petitioner above named in the event of her arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in Darbhanga Sadar Police Station case No. 306 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
