JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2026 Heard Mr. Rajnish Kumar, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 109 and 3(5) of the B.N.S..
3. The prosecution case, in brief, is that on 17.11.2024 at about 9 PM, this petitioner, along with another F.I.R. named accused person, came to the house of informant and asked her son, namely Manohar Pawan to accompany them. Upon refusal, they forcibly took him to the fields near Salona and thereafter, this petitioner restrained him and co-accused Manish Kumar assaulted on his head with iron rod. Upon receiving information about the incidence, the informant reached the place of
Patna High Court CR. MISC. No.30402 of 2026(3) dt.01-07-2026 2/3 occurrence where the accused persons assaulted her with bricks causing head injuries.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of assaulting on the head of son of informant with iron rod is against co-accused Manish Kumar. So far as this petitioner is concerned, there are general and omnibus nature of accusation and no specific allegation of overt act has been levelled against him. Doctor has found the injuries, allegedly caused by this petitioner, simple in nature. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, nature of injuries allegedly caused by this petitioner and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
