JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 25(1-b) a, 26,35 of the Arms Act.

Learned counsel for the petitioner submits that in a case being Bhabua ( Sonhan) P.S. Case No. 56 of 2014 was instituted on 10.2.2014 only the petitioner has been made accused. As an offshoot of the same occurrence, the case under Sections 25(1b)a,26 and 25 of the Arms Act has been instituted. He has further submitted that the petitioner has been granted anticipatory bail in the main Bhabua (Sonhan) P.S. case No. 56 of 2014 by an order dated 11.2.2015 passed in Cr. Misc. No. 35997 of 2014.

Patna High Court Cr.Misc. No.51432 of 2014 (2) dt.07-05-2015 It has further been submitted that the petitioner has no criminal antecedent save and except the other Bhabua ( Sonhan ) P.S. case No. 56 of 2014.

In view of the submission as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in Bhabhua ( Sonhan) P.S. Case No. 59 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J) ArunKumar/- U
