The petitioner seeks bail in a case instituted under Sections 27(b)(ii) 28/28A, D and C Act, 1940 and Section 22(b) of N.D.P.S. Act.

It is alleged that on inquiry by the Drug Inspector, four bags of Corex cough syrup are said to have been recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.09.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made

Patna High Court Cr.Misc. No.42019 of 2016 (3) dt.16-02-2017 2/2 accused due to mistake of fact. There is no recovery of any incriminating article from the possession of the petitioner. The alleged articles, which are said to have been recovered, are cough syrup.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Bhagalpur, in connection with Kotwali P.S. Case No. 386 of 2016.
