ANSARI ORAL ORDER 07-05-2015 This is an application, made under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail by the petitioners, namely, Ram Vinay Paswan, in connection with Special Case No. 1 of 2013 arising out of RC 23 of 2013 under Section 120(B)/409/420/467/468/471 of the Indian Penal Code and Sections 13(2) read with 13(1)(C) and (d) of Prevention of Corruption Act, 1988.
Heard Mr. Uday Bhanu Roy, learned Counsel for the petitioner, and Mr. Bipin Kumar, learned Standing Counsel, appearing on behalf of the C.B.I..
Perused the above application and materials on record.
Considering the fact that similarly situated accused
Patna High Court Cr.Misc. No.26006 of 2014 (10) dt.07-05-2015 2/2 persons have been granted the benefit of pre-arrest bail by a Bench of this Court by order, dated 14.11.2014, passed in Cr. Misc. No. 25429 of 2014 and Cr. Misc. No. 23157 of 2014, it is hereby, in the interest of justice, directed that the petitioner above-named shall, in the event of his arrest in connection with the case aforementioned, be released on bail of Rs. 10,000/-, with two sureties of the like amount, subject to the satisfaction of the concerned Investigating Agency. This direction for pre-arrest bail is further subject to the condition that the petitioner above-named shall, within ten days from today, appear before the concerned Investigating Agency, and make himself available for interrogation by police at all reasonable time and shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
This application for pre-arrest bail shall stand disposed of in terms of the above observations and directions. (I. A. Ansari, J) Pawan/- U T
