JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 27-01-2017 The petitioner of both the aforesaid applications seeks bail in connection with Barauni (Chakiya) P.S. Case No.28 of 2016 registered under Sections 364(A)/34 of the Indian Penal Code. Therefore, both the aforesaid applications have been heard together and are being disposed of by this common order.

Patna High Court Cr.Misc. No.53368 of 2016 (3) dt.27-01-2017 2/3 Learned counsel appearing on behalf of the petitioners submits that the petitioners are not named in the F.I.R. In course of investigation, the names of the petitioners alongwith Manoj Kumar, Kismat Kumar, Sonu Kumar and Monu Kumar have come in the confessional statement of the co-accused Manish Kumar. Except that, there is nothing against the petitioners to show their involvement in the commission of the alleged offence. Moreover, the co-accused Manoj Kumar vide order dated 20.08.2016 passed in Criminal Misc. No.33047 of 2016 and Kismat Kumar alias Bandhan alias Bandhan Kumar vide order dated 19.11.2016 passed in Criminal Misc. No.

40455 of 2016, whose names have also come in the confessional statement of the co-accused Manish Kumar alongwith the petitioners, have already been granted bail by different Benches of this Court. Further submission is that the petitioner Guddu Singh (in Criminal Misc. No.53368 of 2016) is in custody since 23.01.2016 whereas the petitioner Sanjit Kumar alias Sanjeet Kumar (in Criminal Misc. No.55036 of 2016) is in custody since 21.03.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction

Case No.28 of 2016. Out of the two sureties, one must be close relative of the petitioners, who will file an affidavit giving genealogy as to how he/she is related with the petitioners. The bailors will undertake to furnish information to the court about any change in the address of the petitioners.
