JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 01-05-2019 The appellant seeks bail in connection with Simri P.S. Case No. 156 of 2015, registered for offences punishable under Sections 341, 342, 323, 379, 504 of the Indian Penal Code, Section 3(x) of SC/ST Act and Sections 8, 12 of the POCSO Act.
Allegation against the appellant is of misbehaving with the daughter of the informant and when the son of the informant complained about the same, he was assaulted by the appellant. Submission of learned counsel for the appellant is that the allegation is false and concocted and the petitioner is in custody for more than two years and he is ready to abide by any condition imposed on him.

APP (SJ) No.1370 of 2019 dt.01-05-2019 2/2 Having heard both sides, considering the facts and circumstances of the case as stated above, let the appellant, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge (SC/ST and POCSO Act) Darbhanga, in connection with Simri P.S. Case No. 156 of 2015 with condition to cooperate in disposal of the trial and appear as and when required, otherwise his bail bonds shall be cancelled. Accordingly, this appeal is allowed and the impugned order is set-aside.
