The Petitioner seeks bail in Jakkanpur P.S. Case No.21 of 2016 instituted for the offence under Section(s) 3⁄4 of the Explosive Substance Act.
It is alleged in the written report that on confidential information the police interrogated this petitioner, who disclosed that he has kept bomb in his house with intention to kill the informant of Kankerbagh P.S. Case No.50 of 2016. The police raided the house and recovered one live bomb. Seizure list is enclosed with the written report from which it appears that there was no bomb recovered from the premises of this petitioner. It is mentioned in the seizure list that
Patna High Court Cr.Misc. No.2241 of 2017 (2) dt.04-02-2017 2/2 various articles have been recovered, which the police alleges to be used in preparing bomb. The petitioner is in custody since 18.03.2016.
In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Jakkanpur P.S. Case No.21 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
