JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Supaul P.S. Case No. 508 of 2018 registered for the offences punishable under Sections 198, 420, 467, 468, 477A and 120B of the Indian Penal Code.
In view of direction of this High Court in CWJC No. 15459 of 2014 a vigilance inquiry was made with respect to appointment of Panchayat Teacher and several irregularities were found and it appears that petitioner was working as Panchayat Secretary and he is found to be responsible in the appointment of Panchayat Teachers on fake certificate. Heard learned counsel for the Vigilance Department. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 508 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bonds shall be cancelled.
